Agreement

These Terms of Service ("Terms") constitute a binding agreement between you, the user ("User"), and MagicSpace SEO ("MagicSpace"), the owner and operator of the MagicBuddy Telegram chatbot ("MagicBuddy"). By using MagicBuddy, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use MagicBuddy.

1. Services

MagicBuddy is a chatbot powered by AI language models ("AI") designed for conversational interaction and information retrieval. MagicSpace provides the following services under these Terms:

• Access to the MagicBuddy chatbot within the Telegram platform.
• Use of the AI for text-based interaction and limited functionalities as defined within the app.
• Access to certain features may require upgrading to a paid plan.

2. User Conduct

You agree to use MagicBuddy in a lawful and ethical manner and comply with all applicable laws and regulations. You are prohibited from using MagicBuddy:

• To transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially or ethnically offensive.
• To impersonate any other person or entity.
• To interfere with or disrupt the MagicBuddy service or servers.
• To attempt to gain unauthorized access to MagicBuddy accounts or data.
• To create or use any automated system to access MagicBuddy, such as bots or scripts.
• To violate any intellectual property rights of MagicSpace or any third party.

3. User Content

You retain ownership of any content you submit to MagicBuddy ("User Content"). However, you grant MagicSpace a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, translate, distribute, and display User Content in connection with the operation and maintenance of MagicBuddy.

4. Disclaimer

MagicBuddy is provided "as is" and "as available" without warranty of any kind, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. MagicSpace does not warrant that MagicBuddy will be uninterrupted, error-free, or completely secure. You acknowledge that the use of MagicBuddy is at your own risk.

5. Limitation of Liability

MagicSpace shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of MagicBuddy, even if MagicSpace has been advised of the possibility of such damages.

6. Termination

MagicSpace may terminate your access to MagicBuddy at any time, for any reason, without notice. MagicSpace may also remove User Content that violates these Terms.

7. Indemnification

You agree to indemnify and hold harmless MagicSpace and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of MagicBuddy or your violation of these Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Zug, Switzerland.

9. Entire Agreement

These Terms constitute the entire agreement between you and MagicSpace with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

11. Waiver

No waiver of any provision of these Terms shall be effective unless in writing and signed by both you and MagicSpace.

12. Updates to Terms

MagicSpace may update these Terms at any time by posting the amended terms on the MagicBuddy website. Your continued use of MagicBuddy after the amended terms are posted constitutes your acceptance of the amended terms.

14. Age Requirement

You must be at least 13 years old to use MagicBuddy. If you are under the age of 18, you declare that you have the consent of your parent or guardian to use our service.

15. Changes to Services

MagicSpace reserves the right, at its sole discretion, to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that MagicSpace shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

16. Refund Policy

MagicSpace, in collaboration with Lemon Squeezy LLC for payment processing, offers a satisfaction guarantee with a 7-day refund policy for our paid plans. If you are not satisfied with your purchase for any reason, you are eligible to request a full refund within 7 days of the transaction date.

To request a refund, please reach out directly to us at [email protected] with the subject "Refund Request - Lemon Squeezy." Your request should include the following information for us to process it efficiently:

• The full name and email address associated with your MagicBuddy account.
• The transaction ID or any proof of purchase provided by Lemon Squeezy LLC.
• A brief explanation for the refund request, which will help us understand how we can improve our service.

Upon receipt of your refund request, we will review it and, if approved, initiate the refund process through Lemon Squeezy LLC. Refunds will be credited back to the original method of payment and should be reflected in your account within 7 to 10 business days, depending on your bank's processing times.

Please note that this refund policy applies only to purchases made directly through MagicSpace and processed by Lemon Squeezy LLC. For purchases made through third-party platforms or services, you will need to contact them directly for refund requests, as those transactions are subject to the refund policies of the respective service providers.

This refund policy is part of our commitment to ensuring customer satisfaction and does not affect any statutory rights that you may have under law.

Your security is important to us, especially as MagicBuddy operates within the Telegram platform, managed by Telegram FZ-LLC. We strongly advise you to take all necessary precautions to secure your account on Telegram to ensure a safe and secure experience while using MagicBuddy.

• Telegram Account Security: Ensure that your Telegram account is secured with a strong password and enable two-step verification for an added layer of security. Telegram FZ-LLC provides several security features to protect your account, including login alerts and the ability to set up a PIN or password. • Secure Your MagicBuddy Interactions: Be cautious of phishing attempts and suspicious links. MagicBuddy will never ask for your sensitive personal information, such as passwords or payment details, through chat. Always verify the authenticity of any requests or communications that appear to be from MagicBuddy or Telegram FZ-LLC.

• Reporting Security Concerns: If you suspect that your account has been compromised or if you encounter any security issues within MagicBuddy, please contact us immediately at [email protected]. Additionally, any security concerns related to your Telegram account should be reported directly to Telegram FZ-LLC through their official support channel.
